Senate Passes S.204 Trickett Wendler Right to Try Act of 2017
The Senate passed "right-to-try" legislation on August 3, 2017. The version passed is an updated version of a bill proposed by Sen. Ron Johnson (R-Wis.) in January. The revised Act clarifies that drug manufacturers and physicians will not be held liable for adverse events arising from the use of investigational drugs outside of a clinical trial. Further, the bill requires companies to report safety events to the FDA. Additionally, there is a provision that may potentially enable expanded access data to support some registration applications.
